TERMS AND CONDITIONS
- Agreement / Documentation to own a commercial building unit / space are:
a) An agreement to construct to be executed between the builder and the purchaser for the construction of the shop/office allotted to the purchaser. The consolidated contract value includes the cost of the undivided share of land.
b) A 'Sale Deed' for the undivided share of the land to be registered or caused to be registered by the builder on receipt of entire payment under the contract.
- Registration charges, lawyer fee, sales tax, corporation tax and building tax, property tax, statutory fees/charges, stamp duty, electricity connection, cum metro deposit, water charges, K.S.E.B deposit, cable charges, and other expenses incidental to power and lighting connection which at present levied by Government or proposed to be levied and that may be levied or imposed in future and may be enhanced from time to time will have to be borne by the buyer, who will also be liable to pay such amounts within 30 days from the date of demand by the builder.
- The purchaser shall be the member of the Shop/Office Owners Association / Society constituted by the builder, which shall be formed at the time of handing over the possession of the Shop/Office space. The Association / Society shall carry out all necessary routine and annual maintenance of and repairs to common areas, exterior walls of the building, common installations and fittings, payments of electrical and water charges for common services, security arrangements and all such other common facilities and services. Maintenance charges / deposits are to be paid by each owner regularly and on time.
- All measurements and specifications given along with these details are subject to minor variations / alterations without specific or general notice. All such variations / alterations shall be purely at the discretion of the builder.
- The plans are not drawn to scale and are included for the purpose of identification and guidance only. Furniture layout is only an indication of space utilization.
- The area is inclusive of common areas and wall thickness.
- The prices are firm once the space is allotted.
- Sanctioned building plans, title deeds and agreements pertaining to land are available for reference.
- All transactions are subject to Ernakulam Jurisdiction only.
- Midtown Square is a time-bound project. In case payments are not made as per agreement signed, the builders reserve the right to cancel the allotment, in which case the amount will be returned only after re-allotment to another party and without any interest.
- Completion and delivery dates are indicated to give an idea of probable completion of the project. Every effort will be made to obtain Electrical, Sanitary and Water connection within the stipulated delivery date. However no responsibility is accepted for any delay beyond the company's control in obtaining these services from statutory bodies. Any expenses incurred for providing temporary supplies for the occupation of the premises shall be met by the allottee.
- All payments should be through demand draft in favor of ATN Builders by crossed account payee only. Local cheques are also accepted.
- For delayed payments from schedule, we will be charging 18% bank interest.
